This blog was created to offer the reistends a venue that would make it possible to share information and easily communicate with one another about matters that take place in our community and or affect our community.I just received the below enclosed e-mail. I find the possible ramifications interesting; I'm curious what your thoughts might be.Dear Mr. Wood: The purpose of this communication is to inform you that it is possible, if not probable, that some reistends of the Desert Horizons Subdivision will find it necessary to express their freedom of speech rights by picketing the Desert Horizons Owners Association. The need for such actions will arise from any attempt by certain homeowners, who are also Desert Horizon County Club (Club) members, to impose a mandatory Club membership upon existing homeowners who are not now members of the Club. Some non-club members believe that the imposition of such a membership by a majority of Club member owners would be a violation of the United States Constitution. Freedom from a compelled association, especially an association compelled by a “private government,” is a vital component of freedom and demands a public defense that includes the expression of our freedom by peaceful picketing. The federal constitution and the state constitution give us the right to picket with certain limitations to protect the public. These restrictions would not seem to apply to our proposed actions. Specifically, our picketing would not be to instigate a riot, intimidate those passing by, or block the Highway 111 gate into Desert Horizons. Our purposes would be peaceful and informational.We understand that as long as the speech we convey is constitutionally permissible, the state, county, and city governments are all permitted, in the interest of public safety, to regulate the time, place, and the manner of our picketing. Accordingly, we ask you and/or the appropriate staff members to advise us in accordance with City and County Ordinances if, (1) we need a permit and (2) the limits, if any, to picketing with regard to time and place.Sincerely,Edwin J. To: City Leadership and ResidentsFrom: Andy ElchuckSubject: CVEP/RDA $100,000 ContributionAs an attendee of the Thursday February 2, 2012 Council Meeting I repfectsully offer the following observations.In a previous council meeting the City of Indian Wells made a commitment to contribute $100,000 of RDA money to fund CVEP on an annual basis.The state of California in all of its wisdom has eliminated all RDA’s effective February 1, 2012 with the passage of AB1X26. Therein lies the dilemma. The City Manager, Director of Finance, and Legal Counsel agree that the law is vague and lacks clarity and they expressed apprehension on using RDA funds for this purpose and they felt the oversight board would probably reject the use of RDA funds for this contribution. If this happens the City of Indian Wells general fund would be responsible to fulfill the $100,000 CVEP contribution.In spite of the financial condition the city finds itself in and considering the dire actions it was forced to take such as terminating employees, reducing employee salaries, eliminating resident amenities, eliminating charitable contributions to worthy causes, and many more cutbacks that you are all familiar with. Never the less our city council proceeded to vote that the city contribute $50,000 from the city’s general fund immediately and contribute another $50,000 from RDA funds if the state officials and the oversight boards allow this transaction, which is doubtful. This begs the question, if the RDA rejects the request to fund CVEP with $50,000 will the City of Indian Wells be obligated to once again dip into its limited general fund to fulfill their commitment?Mr. Oliphant a founder of CVEP and former Indian Wells Mayor made an impassioned plea for the full $100,000 funding of CVEP and characterized our contribution as a “smart investment”. It may be a smart investment from CVEP’s point of view, but in light of the elimination of the RDA which has left our city with many unresolved financial issues and with formidable fiscal challenges that are foreseeable for the next few years. It is this taxpayer’s opinion, that I find the city councils actions to be imprudent if not down right irresponsible.On Tuesday February 2, 2012 at 1:30 pm the City of Indian Wells 2011/2012 budget had approximately $300,000 in reserve, a paltry amount as compared to years past, and at 4:00 pm the same day the reserve was reduced to approximately $225,000. This reserve needs to serve our city through our fiscal year which ends June 30, 2012. Taking into consideration the past performance of our city council and its spending habits or the lack thereof, do you think we will finish our fiscal year on budget, in surplus, or in deficit?

INDIAN WELLS WILL HAVE A NEW CITY MANAGER. GET INVOLVED NOW BEFORE IT BECOMES A FAIT ACCOMPLI AND YOU WILL NOT HAVE A VOICE IN THE MATTER!Some of our city council will be or have even sttaerd the process of hiring a replacement of Greg Johnson, as the City Manager of Indian Wells.Will it be a Fait Accompli? Someone that can be hired by the mayor (Mullany) and mayor pro-tem (Powers) ? And later announced to the residents of Indian Wells including the salary and benefits given to this person.Or can the person only be hired by a unanimous vote of all five (5) sitting council members. In other words if all five (5) members of the council are not in attendance there cannot be a vote. And the salary paid and benefits given again requiring a unanimous vote of all five (5) sitting council members. Plan the questions you may have regarding this matter. And ask them at the next city council meeting November 3, 2011. Hopefully Mayor Mullany will use good judgement by requiring council members (including himself) or the city attorney to answer the questions asked.Denny Booth A resident of Indian Wells since June 7, !998
